Welcome to Tunog Kalye Radio, accessible at hub.tunogkalye.net (the "Hub"). These Terms of Service ("Terms") govern your access to and use of the Hub, including all features, services, content, and functionality made available through it.

Tunog Kalye Radio is a broadcasting network and media platform dedicated to Filipino independent music. By accessing or using the Hub, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Hub.

The Hub includes, without limitation, the merch store, music submission portal, artist dashboard, fan dashboard, infrastructure support pathways, sponsorship inquiry forms, and all related content and services.

To access certain features of the Hub, including purchasing merch, managing an artist store, or using a dashboard, you may be required to create an account.

You must be at least 18 years old to create an account and use the Hub. By creating an account, you represent and warrant that you are 18 years of age or older.

You agree to provide accurate, current, and complete information during registration and to keep such information up to date. Providing false, misleading, or incomplete information may result in suspension or termination of your account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.

We reserve the right to suspend or terminate any account at any time, with or without notice, if we believe that the account has violated these Terms or for any other reason at our sole discretion.

Tunog Kalye Radio operates under an Open Kanto Policy. Independent Filipino artists and bands may submit their music for consideration, regardless of label status, production quality, or experience level.

By submitting music, you grant Tunog Kalye Radio a non-exclusive, worldwide, royalty-free license to broadcast, stream, publicly perform, reproduce as necessary for technical delivery, and promote your submitted music in connection with the Hub and our radio services. This license does not transfer ownership of your work.

You retain full ownership of your music and all associated copyrights. You may distribute, license, and publish your music on any other platform at any time.

There are no advance recoupment clauses, no exclusivity requirements, and no minimum commitment periods. Submission to the Hub does not limit your ability to exploit your music elsewhere.

We may approve or decline any submission at our discretion based on programming fit, quality, and community standards. Not all submissions will be accepted for airplay or promotion.

By submitting music, you represent and warrant that you are the original creator of the work or are authorized to submit it on behalf of the rights holder, and that the submission does not infringe upon any third-party rights.

The Tunog Kalye Merch Store (the "Store") allows verified artists to sell merchandise directly to fans through hub.tunogkalye.net.

For each sale, 90% of the sale price, minus applicable taxes and payment processing fees, is transferred directly to the artist via Stripe Connect. The remaining 10% is retained by Tunog Kalye for operation costs, including platform maintenance, server hosting, bandwidth, and ongoing development.

Artist payouts are processed automatically through Stripe Connect. Artists are responsible for creating, configuring, and maintaining their Stripe Connect account in good standing.

Artists may fulfill orders themselves or use any platform fulfillment option we may provide, where applicable. Shipping costs, handling, delivery timelines, and fulfillment obligations are the responsibility of the artist unless otherwise stated.

All product listings are subject to review. Tunog Kalye reserves the right to approve, edit, remove, or reject any listing that violates these Terms, applicable law, or our community standards.

Return, refund, and exchange policies are determined by the individual artist, unless otherwise required by applicable law. Tunog Kalye acts as a platform and is not directly responsible for product quality disputes, returns, or refunds, though we may assist in resolving issues where appropriate.

You agree not to use the Hub for any unlawful purpose or in violation of applicable laws or regulations.

You agree not to:

Post, transmit, or distribute spam, fraudulent content, or unsolicited messages.

Upload, sell, or promote counterfeit, unauthorized, or infringing merchandise.

Impersonate any person or entity, or falsely claim affiliation with any person or entity.

Interfere with, disrupt, or attempt to gain unauthorized access to the Hub, servers, or networks connected to the Hub.

Harass, threaten, abuse, or intimidate other users, artists, or staff.

Misuse the Hub in any way that could damage its operations, reputation, or community.

We expect all users to treat each other with respect. Tunog Kalye Radio is a professional media platform serving the Filipino independent music community.

All payments on the Hub are processed securely through Stripe, Inc. ("Stripe"). Tunog Kalye Radio does not store, process, or have direct access to your full credit card or payment information.

By making a purchase on the Hub, you agree to Stripe's terms of service and privacy policy.

Prices are displayed in Canadian Dollars (CAD) unless otherwise stated. Applicable taxes, shipping fees, and payment processing fees may be added at checkout where required.

Artist payouts are processed via Stripe Connect. Payout timing depends on Stripe's processing schedule, the artist's account status, and any applicable payment holds or verification requirements. Tunog Kalye is not responsible for delays caused by Stripe or by incomplete artist account setup.

Infrastructure support contributions made through the "Support the Station" pathway are non-refundable unless required by law. Merchandise purchases are subject to the return and refund policy set by the relevant artist, unless otherwise required by law.

Tunog Kalye Radio operates as a lean, sustainable media business. We believe in transparency about how revenue is generated and how funds are allocated.

Our revenue model may include the following pillars:

B2B Local Sponsorships as a primary revenue source. We sell targeted audio advertisements and digital banner placements to local businesses, including Pinoy restaurants, real estate agents, event promoters, and other businesses serving the Filipino-Canadian community. Sponsorship packages may start at $50 per month.

Merchandise Store Revenue, where 10% of each eligible merch sale is retained by Tunog Kalye for operation costs.

Infrastructure Support Contributions, which help cover server hosting, bandwidth, CDN, and station maintenance costs.

The 10% platform share from merch sales is used exclusively to cover operation costs, including platform maintenance, server hosting, bandwidth, content delivery, and ongoing development. This ensures Tunog Kalye Radio remains operational and sustainable for the community.

No portion of infrastructure support contributions or sponsorship revenue is allocated to the platform operation fund unless expressly stated otherwise. Platform revenues are reinvested into operations, artist development, and community growth.

All content, features, and functionality of the Hub, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the overall design, are the property of Tunog Kalye Radio or its licensors and are protected by applicable intellectual property laws.

Artists retain full ownership and copyright of all original works they submit, list, or sell through the Hub. By listing products, artists grant Tunog Kalye a limited, non-exclusive license to display product images, descriptions, and related promotional materials on the Hub for the purpose of operating the Store and facilitating sales.

Tunog Kalye Radio's name, logo, branding, and related marks may not be used without prior written consent.

User-submitted reviews, comments, feedback, and other content may be used by Tunog Kalye Radio for promotional or operational purposes at our discretion, subject to applicable law.

To the fullest extent permitted by applicable law, Tunog Kalye Radio and its operators, directors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, loss of data, or loss of goodwill, arising out of or related to your use of the Hub.

Tunog Kalye Radio does not guarantee uninterrupted, secure, or error-free operation of the Hub. We are not liable for any downtime, server errors, technical failures, or interruptions.

The Hub is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Tunog Kalye Radio acts as a platform connecting artists, fans, and buyers. We are not a party to transactions between artists and customers, and we are not responsible for shipping issues, product quality, or disputes between users, except as required by law.

We may modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide reasonable advance notice before the changes take effect, where practicable.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Hub after revised Terms become effective, you agree to be bound by the updated Terms.

If you do not agree to the revised Terms, you must stop using the Hub.
